Disclaimer and Release of Liability Form

I hereby acknowledge and agree to the following terms and conditions in connection with the use of the Clubhouse 24/7 Golf Simulator’s facilities. 

1. Assumption of Risk: I acknowledge that the use of the 24/7 golf simulator involves certain inherent risks, including but not limited to the risk of personal injury or property damage. I voluntarily assume all risks associated with the use of the golf simulator.
2. Release of Liability: In consideration of being permitted to use Clubhouse 24/7 golf simulators, I hereby release, waive, discharge, and covenant not to sue the owner, operators, and employees of the facility where the golf simulator is located from all liabilities, claims, actions, damages, costs, and expenses that I may have against them arising out of or in any way connected with my use of the golf simulator.
3. Acknowledgement of Rules and Guidelines: I agree to abide by all rules, guidelines, and instructions provided by the facility regarding the use of the golf simulator. I understand that failure to follow these rules may result in my removal from the premises and the termination of my use of Clubhouse locations. 
4. Use of Personal Equipment: I acknowledge that I am responsible for the proper use and care of any personal equipment that I bring to use with the golf simulator. I agree to use such equipment in a safe manner and in accordance with the manufacturer's instructions.
5. Release of Image and Likeness: I hereby grant permission to the facility to use, reproduce, and distribute any photographs, video recordings, or other media in which I may appear while using the golf simulator for promotional or marketing purposes.
6. Limitation of Liability: I understand and agree that the facility shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with my use of the golf simulator, even if the facility has been advised of the possibility of such damages.
7. Indemnification: I agree to indemnify and hold harmless the facility, its owners, operators, and employees from any and all claims, liabilities, damages, and expenses, including attorney fees, arising out of or in connection with my use of the golf simulator.
8. Acknowledgement of Understanding: I have read and understand the terms of this Disclaimer and Release of Liability Form. I acknowledge that by signing this form, I am giving up certain legal rights and remedies.
9. Customer that books must be present at all times. The booking Participant must be at least 18 years of age. Any damage to the facility by the participant or the group, will be charged to the booking participants payment method at Clubhouse’ discretion. 
10. Alcohol consumption is NOT allowed in any Clubhouse 24/7 Golf Simulator Locations. 
11. Leave the Clubhouse in the same condition you found it in for the next club member to use. 
12. Any issues with the clubhouse should be reported to admin@clubhouse247golf.com
13. If the Box or any part of the Clubhouse is left in a state unable to be used or cleaned up by the next member you will incur cleaning fees. Standard fee $30 to reset the bay. If equipment is damaged due to improper use of facilities the customer will be responsible for replacement costs.

By agreeing and booking, you acknowledge that you have read and understand all the terms and conditions outlined above. Failure to adhere to rules could restrict future use of facilities.
